Legislative Actions Constituting the Oath Of Office Index1. H.R 6166, The Tyrrany Act. House Resolution 6166, the Tyrrany Act, installs undemocratic executive committees without review to designate citizens and noncitizens alike as enemy combatants without standards for proof. It allows hearsay evidence to be used to convict an accused person. It nullifies the right to a speedy trial and replaces a jury with military officers. It allows court proceedings to be classified. It permits indefinite detention without the right to review or challenge.
The Fifth Amendment to the United States Constitution clearly mandates that no person be deprived of life, liberty, or property, without due process of law. The Sixth Amendment to the Constitution requires that in all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the state and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the assistance of counsel for his defense. Because the Tyrrany Act violates the Fifth and Sixth Amendments to the Constitution, it is a legislative assault upon the Constitution itself. The House passed H.R. 6166 in a flagrant betrayal of the Senate Oath of Office.

A YES vote on H.R. 6166 is a direct frontal assault upon the Constitution.
2. Patriot Act Reauthorization. To reiterate, the Fourth Amendment to the Constitution of the United States mandates that The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.
The Patriot Act is a violation of the Fourth Amendment, since it permits the executive branch of the government to spy on the legal, personal activities of Americans who not only have not broken the law, but for whom there is no probable cause to suspect lawbreaking. The Bush Administration is using that power to grab pieces of information and assemble them into a single giant computer database through which the private affairs of every American citizen can be tracked by government officials. Under the Patriot Act, the people are no longer secure in their persons, houses, papers or effects.
A NO vote on Patriot Act reauthorization is a vote to support and defend the Constitution.
A YES vote on Patriot Act reauthorization is an attack upon the Constitution.
3. The Farr Amendment. Section 102 of House Resolution 418 authorizes the Secretary of Homeland Security to nullify any law she or he deems necessary to build roads and fences in the vicinity of a national border. Furthermore, Section 102 of H.R. 418 makes it legally impossible for any court or agency of the government to review the Secretary of Homeland Security's decision to nullify any law. In short, Section 102 places the Bush administration untouchably above the law. This is a direct contravention of Article I of the Constitution, which places legislative power solely in the hands of the Congress. Article II, which concerns the President and the Executive branch, provides neither him nor his underlings with the ability to disregard law.
The Farr Amendment would have stricken this language, and only this language, from H.R. 418, making a vote for the Farr Amendment a vote for the rule of law as envisaged under the United States Constitution.
A YES vote on the Farr Amendment is a vote to support and defend the Constitution.
A NO vote on the Farr Amendment is an attack upon the Constitution.
4. The Scott Amendment. The First Amendment of the Constitution prohibits government from establishing religion. The The Fourteenth Amendment to the Constitution mandates that the government shall not deny to any person within its jurisdiction the equal protection of the laws. House Resolution 27 in the 109th Congress violates both the First and Fourteenth Amendments to the Constitution, by permitting organizations funded by the government to use that government money to hire people, and to apply a religious test in hiring so that only members of the "right" religion get a government-paid job. Because this is a government act that establishes particular religions, and because it permits unequal treatment of people under law, H.R. 27 is doubly unconstitutional.
The Scott Amendment was proposed to remove this language, and only this language, from H.R. 27. The amendment, which failed, was therefore a clear test of a Representative's support for the Constitution.
A YES vote on the Scott Amendment is a vote to support and defend the Constitution.
A NO vote on the Scott Amendment is an attack upon the Constitution.
5. The Hostettler Amendment. Those who voted for the Hostettler Amendment to House Resolution 2862 voted to keep a ruling of a federal court from being enforced. Why? Because a judge decided that a Christian religious monument smacked down onto the grounds of the Gibson county courthouse was an unconstitutional endorsement of one religion over others, a violation of the First Amendment of the American Constitution. The members of Congress supporting this Amendment to H.R. 2862 have taken the position that any personally distasteful court ruling can be overturned by Congress, even though it has been unconstitutional. That is not the rule of law, and that is not respect for the Constitution. It is the rule of a mob running over the standards laid down by the Constitution. It is an arbitrary violation of the separation of powers laid down in Articles I and III of the Constitution, since only the judiciary is granted in Article III, Section 2. That's not just wrong, it is downright unAmerican.
A NO vote on the Hostettler Amendment is a vote to support and defend the Constitution.
A YES vote on the Hostettler Amendment is an attempt to circumvent and weaken the Constitution.
6. H.R. 952, on Extraordinary Rendition. H.R. 952 would put an end to the practice of "extraordinary rendition," in which Bush Administration officials send people into the custody of certain nations, knowing full well (some would say intending) that they will be tortured there. Extraordinary rendition is another stain on the moral clarity of the United States. It is a horrible irony that in a "War on Terror," the United States government would enable the use of torture as a tool.
The Eighth Amendment to the Constitution states that Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted. Torture, because of its nature as a cruel punishment, is unambiguously unconstitutional. Letting someone else do it for you hardly removes the stain of irresponsible unconstitutionality from the United States government.

7. H.R. 1157. H.R. 1157 is a bill which, if passed, would keep government agents from tearing through your bookstore receipts and library records without your permission or knowledge. The Fourth Amendment to the Constitution of the United States mandates that The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized. Thanks to the Patriot Act, the United States Government has moved beyond the Constitution in its powers, taking on the power to search through your papers and effects for evidence of terrorism without a warrant established on the basis of probable cause that describes the the target of the search and the identity of suspected objects or information. H.R. 1157 would restore that constitutionally-required standard, prohibiting personally-identifiable information from being retreived under the Patriot Act and mandating an annual report to Congress detailing searches of libraries and bookstores to ensure that such searches are not abused.

The United States Constitution is the central defining document of America and Americanism. Legislative acts which weaken or act in contravention of the Constitution are therefore not only violations of the Senate Oath of Office; they are unAmerican, even anti-American acts. Anti-American Senators who fail to support and defend the Constitution must be held to account.
